Where does CBD come from?

CBD is just one of more than one hundred phytocannabinoids found in cannabis. Our CBD comes from the female, Cannabis Sativa Plant. Our Full Spectrum CBD

What about THC?

We remove the THC from our oil but legally hemp products can contain up to .3% THC. But even with the highest allowable amount, there is not enough THC to cause a high or register on most standard drug tests. That being said, we provide the certificates of analysis conducted by a 3rd party lab so that you can see what’s in our products so that you can make your own determination. Just scan the QR code on your bottle and you can see the lab results. This way you know exactly what you are consuming or more importantly what you are not.

How do we remove THC?

Once oil from the whole plant is extracted, the small traces of THC in the oil are isolated and removed without harming the other very important cannabinoids and terpenes that naturally occur in our cannabis strain.

Can CBD get you high?

No, CBD is not produced to cause a high or any intoxicating side effects. In fact, CBD can actually lessen the high in someone that has taken too much THC found in marijuana. Scientifically, unlike THC, CBD and the rest of the cannabinoids do not cause a high because the molecules do not act on the same pathways within your body as THC. These pathways, called CB1 receptors, are highly concentrated in the brain and are responsible for the mind-altering effects of THC. A 2011 review published in Current Drug Safety, concludes that CBD “does not interfere with several psychomotor and psychological functions.” The authors add that several studies suggest that CBD is “well tolerated and safe” even at high doses.

Marijuana or Hemp?

Marijuana is the cannabis plant that contains high levels of THC, anywhere from 5-35%. When heated this plant can cause the user to become “high”. CBD on the other hand will never cause this affect. CBD can be extracted from either marijuana or hemp, however CBD extracted from marijuana is not legal in all states. CBD extracted from hemp is legal to be shipped to all 50 states and more than 40 countries around the world.

Understanding Hemp


There are two different types of hemp. One we use for industry and one we use for medicine. Let us explain the difference.

Industrial Hemp

Industrial hemp has been used for decades for things like rope, canvas, paper and so much more. This is where hemp seeds and therefore hemp seed oil comes from. This plant grows up to 20 feet tall. It is not medicine. Its seeds are considered a “super food” because it contains omega fatty acids and other valuable nutrients. This oil makes a great carrier oil and helps our bodies absorb these beneficial cannabinoids. Therefore, we use hemp seed oil as our carrier oil in our CBD BioCare Products.

Medicinal Hemp

Medicinal Hemp looks exactly like marijuana and it grows in a bush. The only difference between this plant and marijuana is the THC content. Legally hemp must contain .3% or less.

Here's where it gets confusing

True industrial hemp is genetically inferior to medicinal hemp, yet it is defined the same way by the regulatory agencies. Many brands, companies and even legal counsel who still believe that hemp-derived CBD must come from overseas to be “fully legal” are not taking into consideration the 2018 US Farm Bill section 7606. As a consumer, understanding the difference is crucial before buying. Otherwise you may not be satisfied with the results or lack thereof.

Cannabis Oil

There are many different oils on the market. Some appear as an option when searching for CBD but don’t indicate any CBD or other cannabinoids when you check out the bottle. It is certainly confusing to say the least. We want to help you know how to make a good buying decision so here is a brief summary.

Hemp Oil

Hemp oil can be any oil derived from hemp. But hemp can be medicinal or industrial. This includes hemp seed oil, full spectrum CBD oil, broad spectrum CBD oil and CBD isolate. You must read the label. Some hemp oil includes oil extracted from the whole plant or just the stalk of the plant. It can also mean hemp seed oil which is pressed from the Cannabis Sativa seeds and does not contain any active cannabinoids which includes CBD. There may be trace amounts from plant residue, but CBD is not a product of the seeds. Be aware, there are companies claiming CBD is in their hemp seed oil, which cannot be true if it is derived only from the seeds.

Full Spectrum CBD Hemp Oil

This is hemp oil that contains all cannabinoids and provides the most medicinal CBD product available. When you have all cannabinoids present, this creates what is called the entourage effect. You can expect a full spectrum product from CBD BioCare. Even though we remove THC from our product, at times trace amounts will be present. There is not enough THC to feel the effects or even fail a standard or common drug test.

Broad Spectrum

Often you will see companies advertise their CBD oil as broad spectrum when the THC is removed. Some suggest that we should also market our oil as broad rather than full because we remove it. Here is the conundrum, legal CBD oil can only have up to .3%, which is practically non existent to begin with. The trace amount is certainly not enough to get you high and not enough to worry about drug testing. Again, during our extraction process we isolate and remove the THC but at times there will be .1% or even .2% THC detected. This is rare but because it happens we can not honestly say zero THC.

CBD Isolate

This is CBD isolated from the plant and is converted into a powder like substance. This isolate is then added to a carrier oil. This product can often be identified because the seller will state it is 99% pure. CBD alone is a great product, as an anti-inflammatory and antioxidant. However, it does not have the medicinal benefits of a full spectrum product.

Cannabis Oil / Marijuana Oil

If the oil is just labeled as cannabis oil it may have THC, making it illegal in most states. It will also contain CBD and other cannabinoids.

History of Cannabis and CBD


You may believe that the healing benefits of cannabis are something new or at least newly discovered due to its presence in modern society but that is far from the truth. Cannabis has been used for medicinal purposes for thousands of years. In fact, the first documented use of cannabis as medicine dates to 2737 BC in China. Chinese Emperor Sheng Nung used a cannabis infused tea for improving memory, malaria and gout. Cannabis has continued to show up in Chinese medicine for thousands of years. In the United States cannabis was openly used and sold in pharmacies in the late 1800’s and it was believed to have medicinal value. It wasn’t until later that scientists discovered the intoxicating side effects of THC. In fact, cannabis as marijuana was not used as a recreational drug until the 1900’s. This practice was introduced to Americans by the Mexicans during the Mexican Revolution. This stoked prejudice and resentment and even hysteria of the “evil weed”. As a result, cannabis was outlawed by 1931.

Discovering CBD

In 1940, American Chemist Roger Adams made history when he isolated the first cannabinoid called Cannabidiol (CBD) from marijuana. His research also led him to discover Tetrahydrocannabinol (THC). Most people give this credit to Dr. Raphael Mechoulam but it was Adams who deserves the credit. Although he separated both CBD and THC, scientist say he did not really know what he had found. It wasn’t until 1946 when Dr. Walter Loewe began testing these cannabinoids on lab animals, but he was unable to identify which compound was responsible for which reaction.

CBD Breakthrough

Dr. Raphael Mechoulam is considered the father of cannabis because he was the first to discover the effects of individual cannabinoids in 1963. Although Adams first isolated CBD and THC he could not define these cannabinoids chemical structure. That credit goes to Israeli scientist, Dr. Raphael Mechoulam. Without his discoveries we would not know that THC is the psychoactive compound in marijuana and that CBD is non intoxicating. After this discovery was made it did not take long for interest in the plants potential medicinal value began to be explored. The first full spectrum CBD oil was released by the mid 70’s.

Advancements in research did not translate to Americans. CBD was unknown and classified as a drug just as marijuana. In 1970, President Richard Nixon signed the Controlled Substance Act as part of the War on Drugs initiative. This placed marijuana on the list as a Schedule I drug along with heroin and LSD. This classification alone, determined that cannabis had no medical benefits and had a high potential for abuse. It was often called a “gateway drug” to more severe drugs.

In 1978 the Controlled Substance Therapeutic Research Act passed. This is significant because it legally recognized the medicinal value of cannabis. It did not specifically name CBD but it was a landmark approval in the United States because it represented the first time a cannabis compound as legal for its medicinal potential.

CBD Shows Promise for Epilepse

In the 80’s Dr. Mechoulam and his team of researchers conducted the first study on cannabis and epilepsy. During the first clinical trial, participants (mostly children) with epilepsy were given 300mg of CBD a day. After just four months, everyone of the participants had an improved condition. Half of the subjects stopped having seizures all together and the others had fewer. This was a huge discovery and had the potential to change the lives of anyone with epilepsy. Sadly, the results that could have sparked worldwide use of CBD to help people with seizures was never accepted and never shared with the public. It is believed that the stigma surrounding cannabis kept this discovery from being acknowledged.

“Who cared about our findings? No one! …And that’s despite many of the epilepsy patients being kids who have 20, 30, 40 seizures a day. And what did they do? Nothing!” Dr. Raphael Mechoulam

The lack of reporting and fanfare did not keep the team from progressing. The next major discovery was about ten years later when this team identified the Endocannabinoid system in the 90’s. This is the system within our bodies that contains a network of receptors that interact and respond with cannabinoids. It was also when the therapeutic benefits of other cannabinoids in conjunction with CBD and THC were discovered.

Cannabis becomes legal in California

In 1996, California became the first state to legalize marijuana under the Compassionate Use Act for people with severe or chronic illnesses. The legalization of marijuana in several states slightly opened the availability for researching CBD for the treatment of a variety of conditions such as pain, epilepsy and many neurological diseases. This marked the beginning of acceptance, but it was still a long way away from being mainstream. Because of CBD’s close relationship to marijuana it was often categorized as a drug and judged under the same laws.

Government secures CBD patent

In 2003, the United States government patents CBD as a neuroprotectant under US patent #6,630,507. It was granted to the U.S. Department of Health and Human Services. It reads as follows: Cannabinoids have been found to have antioxidant properties, unrelated to NMDA receptor antagonism. This new found property makes cannabinoids useful in the treatment and prophylaxis of wide variety of oxidation associated diseases, such as ischemic, age-related, inflammatory and autoimmune diseases. The cannabinoids are found to have particular application as neuroprotectants, for example in limiting neurological damage following ischemic insults, such as stroke and trauma, or in the treatment of neurodegenerative diseases, such as Alzheimer's disease, Parkinson's disease and HIV dementia. Non-Psychoactive cannabinoids, such as cannabidiol, are particularly advantageous to use because they avoid toxicity that is encountered with psychoactive cannabinoids at high doses useful in the method of the present invention. Although this patent was great news it did not help open the door for access to CBD. In fact, CBD remained on the list as a Schedule I drug, along with narcotics such as LSD and Heroin.

A child’s story paves way for acceptance of CBD

Legalization of Hemp

On February 7, 2014 President Obama signed the Farm Bill of 2014 into law. Section 7606 of the act titled, “Legitimacy of Industrial Hemp Research”, defines industrial hemp as distinctly different from marijuana. It conveyed to Departments of Agriculture and Institutions of higher learning the ability to grow, cultivate, process and market hemp as long as research projects were conducted in accordance with state and federal laws. However, it wasn’t until an August 2016, issuance of a Statement of Principles by the USDA (also co-signed by DOJ/DEA and HHS/FDA) that federal agencies had a legal basis for the broad federal acceptance of hemp.

The bill further states that as long as the Cannabis Sativa plant has less than .3% THC it qualifies as industrial hemp. It states growers can extract the CBD and its other cannabinoids from the flowers and leaves instead of the stalk, which is primarily used for industrial purposes. This bill was again passed in 2018, officially named the Agricultural Improvement Act. It passed in December 2018 officially legalizing hemp.

This was a major victory for the industry for several reasons. First and foremost, it removed CBD as a federally registered, Schedule I drug. It also puts no restrictions on the sale, transport, or possession of hemp-derived products, so long as those items are produced in a manner consistent with the law. The bill also opened access to farmers. Hemp will now be treated like other agricultural commodities in many ways. It will remain heavily regulated but become more of a mainstream crop. Farmers will also be able to seek protection under the Federal Crop Insurance Act. This act will assist farmers who face any unexpected crop losses. This protection was unavailable previously. Furthermore, section 7605 and 7501 extends the protections for hemp research and will allow scientists to conduct their studies more freely. This provision recognizes the importance and opportunity of the plant and the products that can be derived from it.

CBD Now Regulated in Florida

On June 25, 2019, Florida's Governor, Ron DeSantis, signed Florida Bill 1020, regulating CBD and other hemp extracts in Florida. As a Florida based company, this is important and exciting information. The bill makes Florida yet another state to regulate the hemp industry, which is good news for consumers and companies dedicated to doing it right. The new Florida law creates a state hemp program within the Department of Agriculture and Consumer Services to promote the cultivation, handling, processing, and sale of hemp, hemp products, and hemp extract.

“Hemp extract” is defined as a substance or compound intended for ingestion that is derived from or contains hemp and does not contain any other controlled substanc­es. Moving forward, no one can sell or distribute CBD in Florida without a certificate of analysis, (COA) prepared by a 3rd party testing facility. It must indicate the hemp extract is the product of a batch tested by the laboratory and that the batch contained a .3% or less THC or tetrahydrocannabinol. The testing results must also prove that the batch does not contain contaminants unsafe for human consumption.

Can I Fail a Drug Test?


It is very unlikely that you would fail a drug test with federally legal CBD products because CBD is not a drug. To be federally legal the CBD product must contain .3% or less THC. That is not enough THC to provide any intoxicating side effects or show up on a drug test.

At CBD BioCare, our oil contains virtually no THC. Once the oil is first extracted, the THC is further isolated and removed. Most often our oil testing shows no detectable amounts of THC in our tinctures. But at times there are legal trace amounts present. This amount is so low it would not show up on standard drug tests.

It is important to note that when an employer is testing your urine, they can set the limits in terms of what constitutes a positive or negative result. Most companies follow the Substance Abuse and Mental Health Services Administration (SAMHSA) guidelines. For THC, according to the SAMHSA, this limit is 50ng/ml. This means that if the urine tested has below this amount in it, the result will be negative. Anything at that level or above would be positive.

If you are concerned, it is always our recommendation, to talk with whomever may be testing you prior to using any of the products, to ensure you don't have any issues. We have heard of numerous employers allowing employees to use CBD hemp products once they have had the chance to research them.

How can CBD work as a topical on the skin?

The human body possesses specific binding sites on the surface of many cell types for cannabinoids, and our body produces several endocannabinoids, that bind to these cannabinoid receptors and activate them. Together they constitute the endocannabinoid system. The endocannabinoid system plays a major role in the body’s response to pain and injury. If your skin is damaged or irritated, your body’s natural endocannabinoids are there to help.
